Times Leader | 04/07/2005 | Public school teachers must be certified CLASS ACTION ROSEMARY JACOBS: "Q. I wonder whether a public high school can still have as well-educated and experienced teachers as private ones. At a recent public high school orientation, I was surprised to learn that teachers hold advanced degrees.

A. It’s a common misconception to think that because a school is private, it must have better-educated, more experienced teachers on staff. Well-educated teachers can be found in public and private schools. Private schools are not required to hire certified teachers, grant tenure, or pay teachers for years of experience, and they often do not. Because they’re not regulated, hiring practices differ. Private schools publicize their teachers’ education, and accomplishments to attract parents and students." (Full story at link)

mysan.de - be updated - Schatz & Nobel, P.C. Announces Class Action Lawsuit Against Doral Financial Corporation: "HARTFORD, Conn., April 22 /PRNewswire/ -- The law firm of Schatz & Nobel, P.C., which has significant experience representing investors in prosecuting claims of securities fraud, announces that a lawsuit seeking class action status has been filed in the United States District Court for the Southern District of New York on behalf of all persons who purchased the publicly traded securities of Doral Financial Corporation ('Doral' or 'the Company') between January 17, 2001 and April 18, 2005, inclusive (the 'Class Period').

The Complaint alleges that Doral and certain of its officers and directors violated federal securities laws. Specifically, defendants orchestrated a massive accounting fraud through which they improperly valued Doral’s Interest Only Strips ('IOs') and misled investors as to the Company’s vulnerability to interest rate increases. Throughout the Class Period, defendants issued highly positive statements in an effort to create the impression that earnings were increasing and that the value of Doral’s mortgage portfolios was robust. In reality, Doral employed a static measure, instead of a forward curve measure, to calculate the value of its London Bank Offered Rate ('LIBOR') sensitive IOs. Doral now admits that this practice resulted in false and misleading results, which Doral now intends to restate. According to its April 18, 2005 press release, the Company’s annual and interim financial reports for 2000-2004 are materially false and misleading requiring restatement because of the Company’s improper accounting treatment of the IOs. During the Class period, defendants sold 579,750 shares for personal proceeds of $20.5 million and completed numerous necessary debt offerings. Doral has also announced that it is not only restating five years of financial statements, but its accounting practices are the subject of an informal SEC investigation." (Full story at link)

Asbestos laws take effect. 04/04/2005. ABC News Online

Asbestos laws take effect. 04/04/2005. ABC News Online: "New asbestos laws have taken effect in the ACT.

Chair of the Asbestos Taskforce Bill Wood says owners and occupiers of homes are required to pass on knowledge in writing of materials containing asbestos to prospective tenants, buyers, tradespeople and maintenance workers.

Mr Wood says the laws will raise awareness about the safe management of materials containing asbestos and could help reduce the instances of asbestos-related diseases in the future.

'When there's any work that's likely to interfere with materials containing asbestos, they're quite safe in bonded form, but we do need to take care if we're handling those, cutting them, sawing them, and if someone for example is doing a bathroom renovation and there might be AC sheeting under the tiles, care needs to be taken in those circumstances,' he said."

Post-Tasini Class Action Case Settling for Up to $18 Million

Post-Tasini Class Action Case Settling for Up to $18 MillionApril 4, 2005 — Four years after the 2001 ruling in their favor by the Supreme Court in the Tasini case (New York Times Co., Inc., et al. v. Tasini et al.), freelance writers finally have some cash in sight. The finding by the Supreme Court established that publishers and the information industry had to get approval from authors to electronically publish reports. (For coverage of the 2001 victory, read Carol Ebbinghouse’s NewsBreak “Tasini Case Final Decision: Authors Win” at http://www.infotoday.com/newsbreaks/nb010628-1.htm.) In August 2000, 21 authors and three author professional associations—the National Writers Union (http://www.nwu.org), American Society of Journalists and Authors (http://www.asja.org), and the Authors Guild (http://www.authorsguild.org)—filed a class action suit. On March 29, 2005, plaintiffs filed a final motion for court approval of a settlement in the suit against database services and publishers, to which the court gave preliminary approval on March 31. The settlement totals a minimum of $10 million and a maximum of $18 million, less $3.8 million for lawyer’s fees and administrative costs. After the 120-day claim period ends (start date to be scheduled by the final court approval hearing on July 28), no further claims by any freelance writers can be made against the database companies or publishers named for covered infringement of electronic rights.

PharmaLive: Barr Says Court Rejects Ciprofloxacin Antitrust Class Action Suits: "WOODCLIFF LAKE, N.J., March 31, 2005 /PRNewswire-FirstCall/ -- Barr Pharmaceuticals, Inc. today announced that the U.S. District Court for the Eastern District of New York has granted summary judgment in the Company's favor and rejected a challenge to the lawfulness of its 1997 settlement with Bayer Corporation of patent litigation related to the antibiotic Cipro(C). In his decision, the Honorable David Trager rejected the plaintiffs' claims that the 1997 settlement violated antitrust and consumer protection laws by delaying the entry of a generic version of Cipro. Judge Trager noted in his opinion that the settlement was not an unlawful restraint on trade, and instead allowed Barr to introduce a competing version of ciprofloxacin a year earlier than Bayer's Cipro patent otherwise would have permitted."
